StaminaSys believes privacy is a fundamental human right, so the "StaminaSys Application" or the "Application" is designed to centralize, minimize the collection and use of data and provide transparency and control over the information of the user and his clients. 

We encourage you to read it thoroughly and are confident that you will easily understand how we gather, store and process your data plus the choices available to you.

Keeping your information safe and increasing transparency is important to us. We are committed to upholding the highest standards of data protection and we thank you for placing your trust in us.

 

StaminaSys may be the Controller or Processor of your personal data provided to us by you or collected by us from you during your use of this application, as outlined below. If you use this StaminaSys Application, you consent to this policy and the use/sharing of your personal data as described herein. You have the choice to opt-out of sharing your data, as described below, and control how we use and share your data.

 

In matters pertaining to Canadian and European laws for the protection of privacy, Mr Michel Dufresne is designated as the data controller of StamynaSys Application.

1. Information Collected and Received.

Staminasys Application may collect or receive personal information about you, including, but not limited to, user name, password, first and last name, email address, street address, gender, occupation, clinical information and interests. You can choose what information you want to input into Staminasys Application, however if you choose to withhold any personal data requested by us, it may not be possible for you to gain the full potential of this Application or its full range of features.  We collect personal information from you at several different points, including but not limited to the following:

  • when we correspond with you as a user or prospective user;

  • when you use Staminasys Application;

  • when you register as an end-user of our Service and an account is created for you;

  • when you provide information, such as survey information;

  • when you contact us for help; and

  • when Staminasys application sends us error reports or application analytics data.

  • Staminasys application does not require you to include sensitive information (e.g. racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union memberships, genetic data, biometric data or data concerning sexual orientation). In the event that you provide such sensitive information as listed above you acknowledge that you have provided us with explicit consent to collect such information.

2. Lawful Basis for Processing.

We will only collect and process your personal data where we have a lawful basis. Our lawful basis includes consent (where you have given it), where the processing is necessary for the performance of a contract with you, and for the purposes of our legitimate interests or the legitimate interests of our third parties, provided that such interest does not outweigh your rights and freedoms. Examples of legitimate interest include but are not limited to: (i) complying with applicable law, (ii) protecting against security or other threats, (iv) administration of our business interests, including improvements and enhancements of our business, and (iv) customer/user relationship issues.

3. Your Rights: Access, Correction, Deletion.

We retain the personal data that you provide to us when you registered by creating your account with Staminasys Application or any other information that you volunteered while using this Application for (i) as long as your account is active or (ii) otherwise for a limited period of time as long as we need to fulfill the purposes for which we have initially collected it, unless otherwise required by law. We retain any information provided as described in the Uses of Information below.

 

You have the right to request access to the information that Staminasys Application has on you. You can do this by contacting us at privacy@staminasys.com in order to comply with your request, we may have to verify your identity. If you believe that the information that we have about you is incorrect, you are able to contact us at privacy@staminasys.com with the request. Note that any data that is no longer needed for the purposes specified above in point 1 will be deleted.

 

You have the right to request the deletion of any personal data that we have on you. If you wish to do so, please contact us at privacy@staminasys.com. Note that StaminaSys may not be able to delete any deidentified data on you. This is data that has been dissociated from your identity and that is used for quality improvement or analytical purposes. Once this data has been deidentified, it may no longer be possible to determine which user it came from. By using this Application, you provide explicit consent to have your data anonymized and used for the purposes described below.


4. How We Use Your Information

(a) Consent to share deidentified information. By using Staminasys Application, all users accept and agree that StaminaSys will be allowed to use any information that they have included in this Application, so long as StaminaSys will first de-identify this information, meaning that we will make the information anonymous by removing the user’s name and other personally identifying pieces of information. We may use this information towards research and development and quality improvement for this Application. 

 

(b) Consent to Share Personal Information. StaminaSys may use personal information that we collect about you to:

  • deliver the products and services that you have requested;

  • manage your customer relationship and provide you with customer support;

  • perform analysis about your use of the application;

  • communicate with you by Email, postal mail, telephone and/or mobile devices about products or services that may be of interest to you;

  • manage our business;

  • respond to investigation, court orders, legal process, or to investigate, prevent or take action regarding illegal activities, suspected fraud, or situations involving potential threats to the physical safety of any person, or as otherwise required by law; and

  • perform functions as otherwise described to you at the time of collection.

StaminaSys occasionally uses other companies to perform services necessary to our operations. In the course of providing these services, those companies will not have access to your personal information which are protected by Encryption. In the event, these companies have access to your personal information in order to provide their services, you agree and consent to such access. By contractual agreement, those companies must treat your information in accordance with this Privacy Policy and sign a Non-Disclosure Agreement. However, we will not be liable for any damages that may result from the misuse of your personal information by these companies.


5. How We Share Your Information.

(a) Personally Identifiable Information. StaminaSys will never sell your email address or any other personally identifiable information to any third party. We may store personally identifiable information in locations outside the direct control of StaminaSys (for example, on servers or databases co-located with hosting providers). Except as described in this Section, we will not disclose your personally identifiable information to any third party except consultants working on our behalf, without notifying you of our intent to share the information and giving you an opportunity to prevent your information from being shared. From time to time, we may partner with companies based on the interests of our users. These partner companies will never see your email address or any other information that could identify you or be used to contact you directly. Your information will never be shared directly with insurance companies or other actors that could use it to limit healthcare options to you or other clients for financial motive.

 

(b) Consent to Share Personal Health Information With Other Clinicians. Each user can accept, after signing his(her) informed consent, that the health information that she(he) supplied in this Application, may be shared with other Clinicians using the Application.

 

(c) Non-Personally Identifiable or “deidentified” Information. The Application’s registration form may require users to give StaminaSys contact information (such as your name and email address) and demographic information (such as your zip code, age). StaminaSys uses your contact information from the registration form to send you information about Staminasys Application. Your contact information may also be used to contact you when necessary. StaminaSys may use demographic and/or profile data to tailor your experience on Staminasys Application, make suggestions that StaminaSys thinks you may be interested in, and display content according to your preferences. Furthermore, StaminaSys shall have the right to retain records of all data pertaining to use of the website and our applications including, but not limited to, usage, activity logs, and click-throughs. StaminaSys may disclose such deidentified data to third parties provided it is grouped with other Staminasys Application users’ data and is presented in an aggregate form. Deidentified data may be shared with researchers and strategic partners to advance research or provide improved products.

 

(d) We May Be Required to Share Your Information. StaminaSys reserves the right to disclose information when required by law, such as by a subpoena or other legal proceedings. StaminaSys may also disclose your information if we reasonably believe it necessary to (i) comply with requests of law enforcement or other applicable law; (ii) to enforce any agreement between you and us; (iii) to protect the security and integrity of our site, applications, or services; and/or (iv) to protect us, our users or others.

 

(e) What Happens in the Event of a Change of Control. We may be involved with an acquisition or divestiture of our business, products or services. Information we maintain including names and email addresses, and other information related to the StaminaSys service may be sold or transferred in connection with such transaction. We may also sell, assign or otherwise transfer such information in connection with a sale of all or substantially all of our business or assets. You will be notified via email and a notice on our website of any applicable change in ownership or use of your information.

 

(f) Testimonials. You may be contacted to ask you if you want, on an anonymous basis, to make a statement about your use of Staminasys Application. If at any point you wish to update or delete your testimonial, please contact us at privacy@staminasys.com.

6.  How We Store and Process Your Information.

(a)  The information collected by StaminaSys may be processed and/or stored in  Canada, United States, European Union Member Nations, or any other country in which StaminaSys or its affiliates or service providers maintain operations. StaminaSys may transfer information that we collect, including personally identifiable information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction of domicile to other countries or jurisdictions. If you are located in the European Union or other regions with laws restricting transferring and location of storage of data, please note that we will comply with laws applicable to us meaning we will ask for your express consent prior to such transfers.

(b) We want to make you aware that pursuant to the EU Data Protection Laws, StaminaSys shall act as a Processor or Subprocessor, and not a Controller with respect to any personal information collected on behalf of our customers. If you are a customer who uses our services and you collect personal information on citizens within the European Economic Area, we ask that you contact privacy@staminasys.com to request a Data Processing Addendum (“DPA”). This DPA implements the GDPR’s Article 28 terms for processors and also incorporates the European Commission’s Standard Contractual Clauses (processors) of 2010 (also known as “model processor clauses” or “SCC 2010”) to facilitate the lawful transfer of Personal Data from the EU to outside of the EU, where necessary and as required.

7. How We Protect Your Information.

StaminaSys is concerned with protecting your privacy and data, and therefore we use industry-standard technologies when transferring and receiving user data exchanged between StaminaSys and other companies to help ensure its security. This Application has security measures in place designed to protect the loss, misuse and alteration of the information under StaminaSys’ control. Staminasys Application’s servers are backed up regularly and protected by security systems. However, we cannot ensure or guarantee the security of any information you transmit to us or guarantee that your information on the Application may not be accessed, disclosed, altered or destroyed by breach of any of our industry standard physical, technical or managerial safeguards. 8. Your Canadian Privacy Rights.

Any personal information that we collect from you is currently stored and processed in Canada. If you are accessing the application outside of Canada, you need to understand that by accessing our Application, you consent to the transfer of your personal information to Canada. Please be advised that Canada’s law may not offer the same privacy protections as the law in your jurisdiction. Deidentified information can be stored in any other country in which StaminaSys or its affiliates or service providers maintain operations as mentioned above. StaminaSys may amend this policy at any time. If StaminaSys is going to use personally identifiable information collected through StaminaSys Application in a manner materially different from that stated at the time of collection, StaminaSys will notify users via email and by posting a notice on the Application or website for thirty (30) days prior to such use. This Privacy Policy may not be otherwise amended except in a writing that specifically refers to this Privacy Policy and is signed by both parties.

 

9. Cookies.

“Cookies” are small pieces of information that are stored by your browser on your computer’s hard drive. Cookies, by themselves, do not tell us your e-mail address or other personally identifiable information unless you choose to provide this information to us by, for example, registering at our website and/or application. However, once you choose to furnish the website and/or application with personal information, this information may be linked to the data stored in the cookie. We use cookies to understand website/application usage and to improve the content and service. We also may use cookies to offer you products or services. You have many choices with regards to the management of cookies on your computer. All major browsers allow you to block or delete cookies from your system. To learn more about your ability to manage cookies, please consult the privacy features in your browser.

10. Links.

StaminaSys may create links to other websites. StaminaSys will make a reasonable effort to link only to sites that meet similar standards for maintaining each individual’s right to privacy. However, many other sites that are not associated or authorized by StaminaSys may have links leading to our site. StaminaSys cannot control these links and StaminaSys is not responsible for any content appearing on these sites.

11. Children's Privacy.

If you are under the age of 18, you should use this application ONLY with the consent and the involvement of a parent or guardian.

12. Successors and Assigns.

This Privacy Policy ensures to the benefit of successors and assigns of StaminaSys.

13. Contacts.

If you have any questions about this Privacy Policy, the practices of this application, your dealings with this Application, or request access, changes or deletion to information we have about you, you can contact Privacy@StaminaSys.com. Upon request, StaminaSys will provide you with access to information (e.g., name, address, phone number) that StaminaSys collects and maintains about you. This Application gives you the following options for changing, modifying or removing information previously provided  email: Privacy@StaminaSys.com

14. Opt-Out.

Staminasys application provides users the opportunity to opt-out of receiving communications from StaminaSys, except transactional correspondence. To opt-out of receiving our communications, you can send an email to Privacy@StaminaSys.com.

This App adheres to the standards of information privacy and security set forth by Canada Health Infoway (Privacy and Security Requirements and Considerations for Digital Health Solutions, version 2.0 - https://www.infoway-inforoute.ca/en/component/edocman/resources/technical-documents/architecture/2154-privacy-and-security-requirements-and-considerations-for-digital-health-solutions) and by the American Health Insurance Portability and Accountability Act (HIPAA - http://www.hhs.gov/hipaa/).

 

The app respects the laws that relate to privacy rights in Canada and Quebec: Personal Information Protection and Electronic Documents Act (PIPEDA) (http://laws-lois.justice.gc.ca/eng/acts/P-8.6/) and P-39.1 - Act respecting the protection of personal information in the private sector (http://legisquebec.gouv.qc.ca/en/ShowDoc/cs/P-39.1).

 

Furthermore, in light of the new General Data Protection Regulation (GDPR) (https://ec.europa.eu/info/law/law-topic/data-protection/reform/rights-citizens_en), here is our new privacy policy.

16. JURISDICTION.

You expressly agree that exclusive jurisdiction for any dispute with StaminaSys, or in any way relating to your use of this Application, resides in the courts of the Province of Quebec, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the Province of Quebec in connection with any such dispute including any claim involving StaminaSys, its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.

These Terms and Conditions are governed by the internal substantive laws of the Province of Quebec, without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and

Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

 

VI. CONSENT TO THE COMPLETE AGREEMENT.

These Terms and Conditions constitute the entire agreement between you and StaminaSys with respect to the use of the Application and Content. By clicking on the checkbox below, "I Accept", you consent and agree to these terms and conditions and acknowledge that you have read and understood them.
